ASHBERRY PRIZE DRAW

Prize Draw Terms and Conditions

To participate in the prize draw is free.

All entries must be submitted via Instagram or by telephone on 0191 2170717 (standard charges shall apply).

The opening date for entries is 12:00 on 13/11/2023. The closing date for entry to the prize draw will be 12:00 on 20/11/2023. After this date no further entries to the prize draw will be permitted.

The prize draw will not be extended past the above stated time and date.

The prize draw is open to residents of England, Wales and Scotland aged 18 years or over, except the Promoter’s employees, their families, agents or contractors, anyone directly connected with the Promoter or any third party associated with the administration of the prize draw.

The prize consists of 1 x White Company London Advent Calendar

Only one entry per person will be accepted. In the event of multiple entries being received from the same account and/or person, only the first entry will be accepted.

The Promoter reserves the right to exclude any entries which it believes are inappropriate and/or fraudulent and/or submitted by misconduct.

The prize is non-transferrable, non-refundable and cannot be exchanged for any cash alternatives in whole or in part.

One winner will be chosen by a random draw performed by a computer process on 20/11/23

The Promoter may have to request further information from the entrant in order to validate their entry. The Promoter will contact the winner by direct message in this case. The information requested must be given to the Promoter within 7 days of request by the Promoter. The winner's prize will be forfeited, if the entrant does not provide the requested information within this timeline and the Promoter will be entitled to select another winner in accordance with the process set out in these Terms.

Once a winner has been selected (and if applicable verified in accordance with clause 11), the Promoter will contact the winner by direct message and ask them to claim their prize by providing their full name and preferred email address within 14 days of contact by direct message, or by post to Ashberry Homes, Woolsington House, Woolsington, Newcastle upon Tyne, NE13 8BF or by email to social@bellway.co.uk or by telephone on 0191 2170717 (standard charges shall apply). If the winner fails to do so within this timeline, the winner's prize will be forfeited the Promoter will be entitled to select another winner in accordance with the process set out in these Terms.

Once claimed within the specified time, the prize will be sent to the winner via post within 30 days of being notified of their win.

Once the winner has claimed their prize, the winner’s details will be published and announced on Instagram.

The Promoter must either publish or make available information that indicates that a valid prize draw took place. To comply with this obligation the Promoter will announce and publish the name of the prize winner and, if applicable, their winning entry, in the comments section of the prize draw on Instagram.

If the entrant objects to its name or winning entry being announced and published or made available, please contact the Promoter [using the contact details outlined in clause 28 below]. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.

The decisions of the Promoter are final and binding and no correspondence will be entered into about it.

All entrants consent to the Promoter collecting, storing and using their personal data submitted with their entry for the purpose of the prize draw only.

Any personal data relating to entrants will be handled and processed in accordance with relevant data protection laws, including The General Data Protection Regulation and the Promoter's Privacy Notice as amended from time to time (available to view at: bellway.co.uk/privacy-notice) and will not be used for marketing purposes without prior consent.

This prize draw is in no way sponsored, endorsed or administered by, or associated with Instagram or any other social media platform or network. You are providing your information to the Promoter and not to any other party, but the prize draw is subject to Instagram’s Terms of Use which can be found here: instagram.com/about/legal/terms

The Promoter does not accept responsibility for entries that are lost or delayed due to network, software or hardware failure or any other reason beyond its control.

The winner may be asked to consent to participate in related publicity without further reward.

The entrant consents to the use by the Promoter of any images that are submitted as part of the prize draw entry for social media marketing purposes and by submitting those images the entrant agrees that its use by the Promoter in the way envisaged by the prize draw will not infringe any intellectual property rights or any other rights of a third party.

The Promoter reserves the right to void, cancel, suspend the prize draw and these terms and conditions without notice where it becomes necessary to do so. Any changes to the prize will be notified to entrants as soon as possible by the Promoter.

Entrants are deemed to have accepted and agreed to be bound by these terms and conditions upon entry. The Promoter reserves the right to refuse entry, or refuse to award the prize to anyone in breach of these terms and conditions.

This prize draw and these terms and conditions are governed by English law and subject to the exclusive jurisdiction of the English courts.
